In the first reporting cycleThe growing importance of environmental, social and governance (ESG) considerations has reshaped business priorities, with regulators, investors, customers and business partners increasingly expecting organisations to demonstrate accountability for their environmental and social impact alongside their financial performance. In response, the Malta Gaming Authority (MGA) has introduced a voluntary ESG Code of Good Practice for the remote gaming sector, providing operators with a framework to promote sustainable, responsible and transparent business practices while supporting Malta's position as a leading gaming jurisdiction.

The Rationale Behind the ESG Code
The MGA identified inconsistent ESG reporting practices and limited public disclosure across the gaming sector. To address these challenges, the Code introduces a standardised framework that enables operators to assess, report on and improve their ESG performance. The initiative also reflects the increasing importance of sustainability reporting at EU level, particularly in light of developments such as the Corporate Sustainability Reporting Directive (CSRD). It helps operators prepare for evolving stakeholder expectations and regulatory requirements.

ESG considerations are increasingly influencing consumer behaviour, investor decision-making and business relationships. As a result, ESG is no longer viewed solely as a compliance exercise but as a strategic consideration that can affect reputation, customer loyalty, talent attraction and long-term business performance. For gaming operators, this makes ESG relevant to both business planning and day-to-day decisions.

Environmental Considerations
While remote gaming operators typically have a smaller environmental footprint than many traditional industries, their operations still have an environmental impact through data centres, cloud infrastructure, business travel and office activities. Recognising carbon emissions as the sector's most significant environmental consideration, the Code encourages operators to monitor and disclose greenhouse gas emissions, energy consumption and environmental management practices, promoting greater environmental accountability across the industry.

Social Responsibility
The social pillar is a central feature of the Code, addressing matters such as responsible gaming, player protection, data security, employee wellbeing, diversity and inclusion, and workforce development. The Code emphasises responsible gaming measures, including safeguards against underage gambling, self-exclusion tools, monitoring of gambling-related harm and clear communication with players. These measures seek to promote a safer gaming environment while encouraging responsible business practices across the sector.

Governance Standards
The Code places significant emphasis on governance, reflecting the highly regulated nature of the gaming industry. Operators are encouraged to maintain robust compliance, anti-corruption, AML/CFT, cybersecurity and risk management frameworks. The Code also promotes accountability through disclosures relating to whistleblower protections, cybersecurity measures, AML/CFT training and board-level oversight of ESG matters.

A Tailored and Flexible Framework
Recognising that gaming operators are at different stages of their ESG development, the MGA has adopted a flexible two-tier reporting framework.
  • Tier 1 serves as a baseline ESG standard for operators that are in the early stages of ESG implementation.
  • Tier 2 represents a more advanced and aspirational reporting level for operators with more developed ESG programmes and reporting capabilities.
To encourage participation, the MGA has introduced an ESG Code Approval Seal, which is awarded to operators that satisfy the reporting requirements applicable to either Tier 1 or Tier 2. Operators that receive approval may display the relevant seal on their websites, publications and marketing materials, demonstrating their commitment to ESG principles. The seal provides formal recognition, promotes industry benchmarking and encourages continuous improvement in sustainability performance. In the first reporting cycle, 14 gaming operators received the ESG Code Approval Seal in recognition of their ESG initiatives.

Significance for Malta's Gaming Industry
The ESG Code has implications beyond individual operators and reinforces Malta's position as a leading and well-regulated gaming jurisdiction. By introducing a sector-specific framework with standardised disclosures and metrics, the MGA seeks to enhance the quality and comparability of ESG reporting across the sector while strengthening stakeholder confidence in the Maltese gaming industry.

The Code's flexible two-tier approach further encourages operators at all stages of ESG maturity to embed sustainable business practices and contribute to the industry's long-term development. For operators, its strategic value lies in using ESG reporting to inform decisions, identify areas for improvement and connect sustainability objectives with business priorities.
